Terms & Conditions

These terms and conditions apply to the Cinephile app (hereby referred to as "Application"), created by Mario Luis Gutierrez Abed (hereby referred to as "Service Provider") as a freemium service.

Acceptance of Terms

By downloading or using the Application, you agree to the following terms. Unauthorized copying, modifying, translating, or reverse engineering of the Application or its trademarks is strictly prohibited. All intellectual property rights remain with the Service Provider.

Modifications and Charges

The Service Provider reserves the right to modify the Application or its services at any time. Any charges for the Application will be clearly communicated to you in advance.

Data and Privacy

The Application processes personal data to provide the Service. You are responsible for securing your device and access to the Application. Jailbreaking or rooting your device may compromise its security and hinder the functionality of the Application.

User Accounts and Community Content

The Application offers optional social and community features. These features are entirely opt-in: you must sign in with Apple or Google to participate, and you may completely hide all community features at any time in Settings. You are solely responsible for the content you post, including comments, profile information, images, ratings, and reviews, and you represent that you have the right to share it. You agree not to post content that is unlawful, harassing, hateful, infringing, sexually explicit, or otherwise objectionable, and not to impersonate others or abuse the service.

By submitting content through the community features, you grant the Service Provider a limited, non-exclusive license to host, store, display, and distribute that content solely for the purpose of operating and providing the Application. The Service Provider may review, moderate, remove, or restrict content, and may suspend or terminate accounts, that violate these terms or that it deems harmful, at its discretion. You may delete your community account and associated content at any time from within the app.

GIFs

Community members may search for and attach GIFs provided by Klipy. GIF availability, metadata, delivery, and licensing are controlled by Klipy and may change or become unavailable. More information appears in the Cinephile Privacy Policy and Klipy's privacy policy.

Third-Party Services

The Application relies on the following third-party services. RevenueCat handles transactions and subscription management (Terms of Service here). Supabase provides authentication, database, and storage infrastructure for the community features (Terms of Service here). The Movie Database (TMDB) provides movie and TV metadata and artwork (Terms of Use here). Trakt provides optional library and watch-history sync when you choose to connect it (Terms of Service here). Klipy provides community GIF search, direct GIF delivery, and view/share reporting (Privacy Policy here).

Liability for Usage

The Service Provider cannot be held responsible for issues arising from the lack of Wi-Fi or mobile network access. It is your responsibility to ensure your device remains charged and has internet connectivity.

Consent to Share Consumption Data with Apple

By using our app and making in-app purchases, you consent to our sharing of data regarding your usage and consumption of purchased content with Apple, as part of our efforts to resolve refund requests. This information may include details about how you have accessed and interacted with the purchased content. The purpose of sharing this data is to help Apple make an informed decision regarding refund requests. We ensure that such data sharing is done in compliance with Apple's policies and only as necessary to process your requests.

App Updates and Compatibility

The Service Provider may update the Application to maintain its relevance. You agree to accept updates when offered. The Service Provider may also discontinue the Application at any time without prior notice.

Changes to Terms

These terms may be updated from time to time. Changes will be posted on this page, and you are advised to review it periodically.
